3. Eligibility and Account Registration

3.1 Eligibility

• Parents/Guardians must be 18 years or older
• School administrators must be authorized representatives of their institution
• Drivers must be licensed and authorized by their school

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access or security breach.

4. User Responsibilities

4.1 For Parents/Guardians

• Provide accurate student and contact information
• Monitor app notifications regularly
• Update pickup/drop-off locations as needed
• Ensure timely payment for services (if applicable)

4.2 For School Administrators

• Ensure accurate route and student data
• Verify driver credentials and vehicle compliance
• Monitor transportation operations
• Respond promptly to emergency situations

4.3 For Drivers

• Maintain valid driver's license and vehicle registration
• Update trip status and student attendance accurately
• Follow assigned routes and schedules
• Report emergencies or breakdowns immediately

5. Prohibited Use

You agree not to:

• Use the Services for any unlawful purpose
• Share your account credentials with unauthorized persons
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Use the Services to harass, abuse, or harm others
• Reverse engineer or copy any part of the application
• Tamper with GPS devices or location data
• Provide false or misleading information

6. Location Services and GPS Tracking

By using WowNear, you consent to:

• Real-time GPS tracking of buses equipped with tracking devices
• Collection of location data during active trips
• Sharing of location information with authorized users (parents, schools, drivers)
• Storage of location history for service improvement and safety purposes

You may control location permissions through your device settings, but disabling location services may limit app functionality.

7. Payments and Subscription

7.1 Fees

Schools and parents may be required to pay subscription or service fees as determined by their school or by Moontrail Systems Private Limited. All fees are non-refundable unless otherwise stated.

7.2 Payment Methods

Payments may be processed through third-party payment gateways. You agree to provide accurate payment information and authorize us to charge the applicable fees.

8. Privacy and Data Protection

Your use of WowNear is also governed by our Privacy Policy. We collect and process personal information including:

• Real-time location data
• Trip and attendance records
• Driver and vehicle information

9. Intellectual Property

10. Disclaimer of Warranties

We do not guarantee that:

• The Services will be uninterrupted or error-free
• GPS tracking will be accurate at all times
• Notifications will be delivered without delay
• All technical issues will be resolved immediately

While we strive to provide accurate and timely information, we are not responsible for delays, inaccuracies, or technical failures beyond our control.

11. Limitation of Liability

To the maximum extent permitted by law, Moontrail Systems Private Limited shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from GPS inaccuracies or notification delays
• Accidents, injuries, or incidents during transportation
• Actions or omissions of drivers, schools, or third parties

Our total liability shall not exceed the amount paid by you for the Services in the past 12 months.

You agree to indemnify and hold harmless Moontrail Systems Private Limited, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use or misuse of the Services

13. Termination
